1. bbcdaily currently provides users with access to a rich collection of resources and Service. You understand and agree that the Service is provided "AS-IS" and that bbcdaily assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

2. You must be at least 18 years of age to access and view the site.

3. You agree that all information, data, text, photographs, graphics, messages or any other materials (collectively "Content") are the sole responsibility of the person from which such Content originated. This means that the you, and not bbcdaily, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service.

4. bbcdaily does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will bbcdaily be responsible in any way for any Content, including, but not limited to, for any errors or omissions in any Content. If you have any issues with any of the contents, you agree that you will only contact person from which such Content originated. And you understand that by using the Site, you may be exposed to Content that is offensive, indecent or objectionable.

5. You agree to not use the Service to:
(a) violate any laws;
(b) be false or misleading;
(c) infringe any third-party right;
(d) distribute or contain spam, chain letters, or pyramid schemes;
(e) distribute viruses or any other technologies that may harm bbcdaily or the interests or property of bbcdaily users;
(f) impose an unreasonable load on our infrastructure or interfere with the proper working of the bbcdaily;
(g) copy, modify, or distribute any other person's content;
(h) harvest or otherwise collect information about others, including email addresses, without their consent;
(i) bypass measures used to prevent or restrict access to bbcdaily.
(j) upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, defamatory, abusive, harassing, threatening, vulgar, or libelous;

6. bbcdaily has the sole discretion to decide whether Content or material is prohibited on the Site. You acknowledge that bbcdaily has the absolute right (but not the obligation) to deny, delete and move any Content and material for any reason, in any manner, at any time, without notice.

7. You agree to indemnify and hold bbcdaily, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of these Terms and Conditions, or your violation of any rights of another.

You agree that bbcdaily is not responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of the use of, or in connection with your use of, any Content available via the Service. And under no circumstances, will bbcdaily be held responsible or liable, directly or indirectly, for any damage (whether actual, direct, consequential, incidental, punitive or otherwise) caused to Content you submit, post, transmit or make available through the Service or any loss of any kind (including, but not limited to, loss of or corruption to your Content) however caused.

9. bbcdaily may provide, or third parties may provide, links to other World Wide Web Sites or resources. Because bbcdaily has no control over such Sites and resources, you acknowledge and agree that bbcdaily is not responsible for the availability of such external Sites or resources, and does not endorse and is not responsible or liable for any Content from such Sites or resources. If you decide to visit any linked Site, you do so at your own risk. bbcdaily is not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, products, goods or Services available on or through any such Site or resource. You further agree that bbcdaily is not responsible or liable in any way for the accuracy, relevancy, copyright compliance, legality, or decency of Content or materials contained in any such Site or resource.

10. During the registration process, you will provide a User Name and choose a Password. You are solely responsible for maintaining the confidentiality of your User Name and Password, and are fully responsible for all activities that occur under your User Name and Password. You are allowed to have only one bbcdaily Membership and the privileges associated with Membership. Membership is for personal use only and is non-transferable.

11. If you become a member of bbcdaily, you agree that bbcdaily, at its sole discretion, may terminate your membership, any associated email address, and your use of, or access to, the bbcdaily Site or any of its Services, with or without notice for any reason, including but not limited to, if bbcdaily believes that you have failed to comply with any term or provision of these Terms and Conditions. You further agree that bbcdaily shall not be liable to you or to any other person as a result of any such suspension or termination.

12. bbcdaily reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that bbcdaily shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

13. Using bbcdaily is completely free now. This includes posting an Ad, replying to an Ad, posting in the forums, etc. We may charge fees for premium services such as featuring your Ad in the Top Ads section. Our fees are quoted in Canadian Dollars, and we may change them from time to time. Our fees are non-refundable, and you are responsible for paying them when they're due. If you don't, we may limit your ability to use the services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms.

14. bbcdaily provides a platform for users to connect with one another. bbcdaily does not participate in, nor is it a party to, any activities or transactions of the posters, readers, sellers or buyers. bbcdaily does not screen or control users who may sell or buy on the classifieds, nor does bbcdaily review or authenticate all listings, items, or services offered for sale. Therefore, you understand and agree that:
(a) You (Sellers and buyers) are completely responsible for working out the sale, exchange of goods or services, and for dealing with any disputes or any issues.
(b) You (Sellers and buyers) must resolve any disputes that may arise. It is important to use care throughout your dealings with other people in the process.
(c) You (Sellers and buyers) are responsible for researching and complying with any applicable laws, tax, regulations or restrictions on items, services, or manner of sale or exchange that may pertain to transactions in which they participate.
(d) Ypu (Sellers and buyers) are responsible for all applicable taxes and for all costs incurred by participating in any buy, sell, exchange.

15. bbcdaily respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, or your other rights have been violated, please report to us. bbcdaily may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may be repeat infringers.

16. You agree that bbcdaily reserves the right to amend these Terms and Conditions at any time, for any reason, and with or without notice.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

(a) YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. BBCDAILY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

(b) BBCDAILY SPECIFICALLY MAKES NO WARRANTIES THAT THE BBCDAILY SITE OR ANY OF THE SERVICES, INCLUDING ANY CONTENT, INFORMATION, PRODUCTS OR SERVICES OBTAINED FROM OR THROUGH THE USE OF THE BBCDAILY SITE OR ANY OF THE SERVICES, WILL BE PROVIDED ON AN UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE BASIS OR THAT SUCH SERVICES OR THE RESULTS DERIVED THEREFROM WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

(c) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SITE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT IN NO EVENT SHALL bbcdaily, INCLUDING ITS AFFILIATES AND LICENSORS, BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, AND ANY DAMAGES FOR LOSS OF PROFITS, SAVINGS, GOODWILL OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER BBCDAILY HAD BEEN ADVISED OF OR COULD HAVE FORESEEN THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OR IN CONNECTION WITH: (A) THE USE, INABILITY TO USE OR PERFORMANCE OF ANY OF THE SERVICES OF THE BBCDAILY SITE, OR (B) ANY UNAUTHORIZED ACCESS TO OR MODIFICATION TO ANY OF YOUR CONTENT OR TRANSMISSIONS, OR (C) ANY OTHER MATTER RELATING TO THE BBCDAILY SITE OR ANY OF THE SERVICES.

GENERAL PROVISIONS

The Terms and Conditions constitute the entire agreement between you and bbcdaily and govern your use of the Site, superceding any prior agreements between you and bbcdaily.

These Terms and Conditions will be governed and construed in accordance with the laws of the province of Ontario, Canada, without regard to its conflict of laws provisions. By using the bbcdaily Site you agree to personal jurisdiction of the province and federal courts of the province of Ontario, Canada and to waive any objections based upon venue. Any other terms and conditions not included in this Agreement shall be in accordance with the laws of the province of Ontario, Canada.

bbcdaily's failure to insist upon or enforce strict performance of any right or provision of these Terms and Conditions shall not constitute or be construed as a waiver of any right or provision. If any of the provisions (or parts thereof) contained in these Terms and Conditions are determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions (or parts thereof) contained herein.
